These terms apply to your use of topazfieldgrove.com, which is operated by Topaz Field Grove, 2-18-2 Betsuin, Kitakyushu, Fukuoka 800-0035, Japan. Please read them before you rely on anything you find here. By using the site you agree to them; if you do not, please stop using it.

1. What the site is

This is an information website. It explains how we think about homes, building plots, shared spaces and the development process, and it gives a way to contact us. It is not a property portal, a listing service or a shop. Nothing on it is an offer to sell, lease or broker any home or land, and nothing on it is an invitation to make one.

2. No contract through the site

Sending an enquiry does not create a contract between you and us, does not reserve any home or plot, and does not oblige either side to continue talking. A sale, lease or brokerage of real estate only comes into being when a written contract is signed after the written explanation of important matters (重要事項説明) has been given by a licensed real estate transaction specialist. The licence status of the business is set out in the commercial transactions notice.

3. Illustrations and descriptions

The pictures on this website are illustrations chosen to show a type of home, a kind of landscape or a kind of activity. They are not photographs of completed or planned Topaz Field Grove projects, and the people in them are not our staff or residents. Descriptions of housing types, the development process and legal terms are general and are given in good faith, but they are simplified. They are not advice for your particular situation.

4. Not professional advice

We are not giving you legal, tax, financial, surveying or architectural advice. Questions about a mortgage belong with your bank, questions about tax with a licensed tax accountant, questions about boundaries with a land surveyor, and questions about the structure of a particular building with a registered architect. Please check the points that matter to you with the right professional before you decide.

5. No promises about value or returns

We do not say, and nothing on this site should be read as saying, that any home or plot will keep or increase its value, produce rental income or be easy to resell. Property prices and rents can fall as well as rise.

6. Accuracy and changes

We take reasonable care that the information here is correct on the date shown, but we cannot guarantee that it is complete or current. Laws, fees, procedures and our own plans change. We may edit, add or remove any page without notice. If a point is important to you, ask us to confirm it in writing.

7. Acceptable use

You agree not to use the site or the enquiry form to send unlawful, abusive or misleading material, to send advertising or bulk messages, to try to disrupt or gain unauthorised access to the site, or to copy large parts of it for a commercial purpose without our permission. We may block messages that break these rules.

8. Intellectual property

The text, layout and design of this site belong to Topaz Field Grove or its licensors. You may read it, print a page for your own use and quote short passages with a link back, but you may not republish it or present it as your own. Third-party images are used under the terms on which they were obtained, and the owners' rights in them remain with the owners.

9. Links to other websites

We may link to other sites, such as a map. Those sites belong to other people, and their content and privacy practices are their own responsibility. A link is not an endorsement.

10. Limits of our responsibility

To the extent the law allows, we are not responsible for loss that arises from relying on the general information on this site, from interruptions to the site or the form, or from messages that are delayed, lost or intercepted on the way to us, including through the third-party form service described in the privacy policy. Nothing in these terms limits liability that cannot lawfully be limited, including liability to consumers under the Consumer Contract Act, or liability for our intent or gross negligence.

11. Changes to these terms

We may change these terms. The new version applies from the moment it is posted here, with a new date at the top. If you keep using the site after that, you accept the new version.

12. Governing law

These terms are governed by the laws of Japan. If a dispute with us cannot be settled by talking, the Fukuoka District Court is the agreed court of first instance for disputes with business users, to the extent the law permits. Consumers keep any right to bring a case in the court that Japanese law gives them.
